Terms and Conditions

Voluntary Participation

Before participating in this or any other exercise program, individuals should consult with a physician. Participation is voluntarily chosen and requested.

Acknowledgement

The participant is aware that participation in the yoga class, workshop, event, or activity may be hazardous and acknowledges that a certain minimum level of physical health, strength, fitness, and flexibility will be required. The yoga teachers may physically adjust and correct the student, and should they not wish this to happen, it is their responsibility to notify the teacher at the start of the class. Participation is voluntary with knowledge of the risks of injury. 

 

Individual instructors and yoga teachers

BrightonYoga is a platform for individual, self-employed yoga teachers to provide their services, events, and holidays. If their terms of conditions differ from the ones here, we will show their conditions during the booking process. ​

SMS and Email Notifications

The participant agrees to receive email notifications confirming information on purchases, bookings, class reminders, pass expirations, and cancellations.

Photography/Filming

We reserve the right to photograph or film during our classes and to use these images for our website and marketing purposes. If you don't wish to be photographed or filmed, please let us know!

Under 18s

The person making the booking must be at least 18 years of age and authorised to do so by all persons named in the booking.

 

Pregnancy

Participating in any yoga class, retreat, workshop or any other event whilst pregnant is at your own risk. The teacher or instructor will not be liable for any complications whilst exercising pregnant.

Insurance

As a condition of booking all persons named on the Confirmation/Invoice, including those substituted or added by agreed amendment of the booking, must take out suitable holiday insurance –in particular providing cover for injury to themselves whilst participating in the various sports and activities like hiking, surfing, paddleboarding, or any other activity. It is recommended that the policy also covers cancellation. 

 

Payments

The booking is not confirmed until we receive payment of the deposit. Our trips have limited availability so early booking is advised to avoid disappointment. You must pay the entire balance by the due date set at the time of booking. The balance payment is due no later than four weeks before the day you are due to arrive. If we do not receive your balance payment, your place may be given to another guest. Last-minute bookings must be paid for "in full" at the time of booking.

 

Refunds

BrightonYoga acts as a booking platform for several individual yoga teachers. They might have different conditions, which will be provided and shown at each booking process and in the confirmation. If you, or any member of your party, cancel your booking at any time, written notification from the person who made the booking must be received by email at info@brightonyoga.co.uk. Since we incur costs in cancelling your travel arrangements, the following cancellation charges will be payable by you. The cancellation charge is a percentage calculated based on the total costs payable by the person cancelling, not refundable in the event of cancellation.

 

  • More than 30 days - Deposit  

  • 0-29 days                - 100% of the travel arrangements

Accidents

We do not accept or assume any responsibility or liability for accidents, injuries or even death that occurred while taking part in any trip, event, workshop or retreat. We cannot be held responsible for any costs that may arise.

 

Other activities

Taking part in any activities that have been organised and arranged independently of us, is at your own risk. The participant is responsible for ensuring to obtain the relevant insurance. (ie. surfing, paddle boarding, climbing, swimming)

Cancellation

We are not responsible for any financial loss due to cancellation. Some trips will be subject to group size minimum to run and, therefore, occasionally cancelled. If this is the case, we will inform you, and you will get a full refund. No further claims or losses will be covered.

 

We are exempt from fulfilling our contractual obligations for causes that could not be anticipated and/or are beyond our control, including an act of God, act of man, act of government, and other impersonal events or occurrences. That being said, we have integrity and will endeavour to provide you with the services mentioned. Whilst all reasonable efforts will be taken to ensure this, it may be necessary in some circumstances, eg extreme weather or environmental conditions outside our control. We may need to reschedule outdoor events due to weather conditions.

 

Medical conditions

If you have had any major physical or emotional illness within the past 5 years, or are under medical or psychiatric supervision, you must notify us of the details at the time of booking and, where appropriate, enclose a doctor's certificate of fitness to travel. Persons attending any holidays, events, retreats or classes do so at their own risk. If in any doubt as to the suitability of a particular holiday with regard to your specific experience or abilities, please communicate in writing with the office before booking. Non-disclosure of relevant information can invalidate your insurance and cancel our contractual obligation to you.

 

Complaints:

If a complaint arises that cannot be resolved on the spot, you must immediately contact BrightonYoga by email, who will attempt to resolve it for you immediately. BrightonYoga will always make every attempt to solve the problem at the time of the complaint so that any disruption to the enjoyment of your holiday, retreat, workshop or class is minimal. We regret that we cannot accept liability in relation to any complaint. 

 

Please note that BrightonYoga acts purely and solely as booking agents between you and on behalf of both parties.

Travel

We accept no responsibility for travel tickets such as airfares and trains. This is solely your responsibility to organise and inform us only of an accurate arrival time. If you choose to share cars with other guests whilst on a trip, we are not responsible for any risk, injury or death that occurred through car sharing.

Release

BrightonYoga and their partners won't take any responsibility or liability for any injuries or damages that may sustain due to yoga classes, workshops, events, and activities booked through BrightonYoga. We strongly recommend you take out comprehensive travel insurance at the time of booking.

Medical issues

If in our reasonable opinion your chosen holiday arrangements are not suitable for your medical problem or disability or you are not travelling with someone who can provide all assistance you may reasonably require. In that case, we have the right to refuse to accept the booking. 

 

If you do not give us full details of your medical problem or disability we can also cancel the booking when we find out full details if in our reasonable opinion, the holiday arrangements are not suitable or you are not travelling with someone who can provide all assistance reasonably required.

 

Liability

As part of your booking with us, you accept liability for any loss or damage caused by you or any member of your party during your holiday. Payment for any loss or damage must be made to us or our Supplier/Principal at the time that it occurs or as soon as is reasonably practicable thereafter. 

 

Respectful behaviour

All participants must be respectful and must not engage in offensive, illegal or immoral acts. Should this be a situation or should you become a nuisance to the instructor or teacher, or any other staff, then we reserve the right to ask you to leave and suspend your activities if it is appropriate to do so, without any compensation. We cannot be held responsible for the actions or behaviour of other guests on the trip.
